Assistant Federal Defender – Appellate

About the role

The Federal Public Defender’s Office for the Districts of South Dakota and North Dakota seeks an Assistant Federal Defender focused on appellate work. The attorney will join a collaborative, mission‑driven team and may be based in Bismarck, Fargo, Pierre, Rapid City, or Sioux Falls.

Key responsibilities

• Draft and file briefs, motions, and petitions for rehearing or certiorari in the Eighth Circuit and the U.S. Supreme Court.
• Present oral arguments before the Eighth Circuit Court of Appeals.
• Provide research and writing support to trial attorneys handling district‑court matters.
• Potentially engage in post‑conviction work in district courts as office needs dictate.

Required profile

• Juris Doctor from an accredited law school.
• Admission in good standing to practice before the highest court of a state or the District of Columbia.
• Willingness to obtain bar admission in South Dakota and/or North Dakota within one year of hire.
• U.S. citizenship or authorized to work in the United States.
• Demonstrated commitment to indigent defense and strong collaborative abilities.
